ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
Conditions to Permit Entertainment Involving Lap/Pole Dancing or Strip-tease and or Nudity and/or Sexual Stimulation
1. All references to la/pole dancing or strip-tease shall be deemed to include all forms of lap/pole dancing or strip-tease or nudity, including the wearing of 'see through' clothing and sexual stimulation.
2. The Licensed activities shall take place only in the areas designated by the applicant and access to the dressing room(s) shall be maintained whilst lap/pole dancing or strip-tease entertainment is taking place and immediately thereafter.
3. The lap/pole dancing or strip-tease shall not be in a location where the performance can be seen from the street.
4. The lap/pole dancing or strip-tease entertainment shall be given only by the performer/entertainers and the audience shall not be permitted to participate.
5. Whilst lap/pole dancing or strip-tease entertainment is taking place no person under the age of 18 shall be on the premises. A clear notice shall be displayed at each entrance to the premises in a prominent position so that it can be easily read by persons entering the premises with the following words:
"NO PERSON UNDER THE AGE OF 18 WILL BE ADMITTED"
6. The audience shall not be encouraged or permitted to throw money at or otherwise to give gratuities to the performers.
7. Entertainment may be provided solely by dancers to customers seated at a table in the licensed part of the premises.
8. There shall be no physical contact between customers and the dancers other than the transfer of money or tokens at the beginning or conclusion of the performance.
9. Whilst dancing takes place not less than two door supervisors shall be employed in that part of the premises used for lap/pole dancing.
10. A tamperproof CCTV system shall be installed in that part of the premises used for lap/pole dancing and shall be used during all hours that the lap/pole dancing activity takes place on the premises.
11. The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 31 days.
12. Screen walls shall be constructed within the interior of Bar Rouge so as to obstruct the view from outside Bar Rouge in the event of the entrance/exit/fire doors being opened.
13. All windows to that part of the premises used for lap/pole dancing shall be blackened so as to prevent the interior of the premises being viewed from outside.
14. The internal doors from Bar Rouge to the main foyer of the premises are to be push bar and used as exit only.
15. The internal doors from Bar Two to the toilet facilities and fire exit are to be push bar fire doors for emergency exit only.
16. For the purposes of pole dancing, the pole is to be constructed within the area of the designated dance floor adjacent to the bar counter within Bar Rouge.
The prevention of crime and disorder
A tamper proof CCTV system will be installed at the premises to the satisfaction of Cumbria Police.
All recordings will be kept and maintained for 30 days.
Staff will be trained in the use and the downloading of recordings from the CCTV system.
All staff will assist police in any enquires carried out by them at the premises.
Notices will be clearly displayed within the premises that it is unlawful to buy or sell alcohol to persons under 18yrs.
Public safety
A fire risk assessment will be completed to the satisfaction of Cumbria Fire Service.
All fire fighting equipment will be maintained in good working order.
All fire exits will be kept clear from obstructions at all times.
Any spillages occurring within the premises will be immediately cleaned and signed by staff.
The prevention of public nuisance
When regulated entertainment takes place all doors and windows will be kept closed to reduce noise levels.
No noise nuisance will be caused to neighbouring properties.
Where a ring is used it will be constructed by a competent person and shall be inspected by a competent authority before use. The seating layout shall be agreed with the competent authority.
SIA Door supervisors will be provided at the premises on Friday and Saturday nights to such a number as the management of the premises consider sufficient. They will be in position from 21.00 hrs until closing time. Door supervisors will also be provided on Public Holidays/Bank holidays and at other times management believe they are necessary.
The designated premises supervisor or his representative shall conduct assessments of the noise coming from the premises when they are used for entertainment after 11pm, and shall take steps to reduce the level of noise where it is likely to cause disturbance to local residents. A written record of shall be made of those in a book and shall include the time/date of these checks, the person making them and any remedial action taken.
The protection of children from harm
The premises will operate a 'Challenge 21' policy for sale of alcohol.
