ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
The premises will be converted in accordance with building regulations application number 05/0711/FP and in accordance with the comments made by the Fire Service.
The application for extended hours has arisen as a result of the incorporation of a restaurant in to the premises and diners will expect to be able to eat and drink for longer hours.
Non alcoholic refreshment will be available in the extended period.
The terms of your Local Licensing Policy have been considered in preparing this application.
No new steps have been identified in relation to the four Licensing Objectives except as set out below.
Section 177 of Licensing Act 2003 applies to these premsies. This means that any conditions imposed relating to the provision of music entertainment:-
should not have any effect at all in relation to live and amplified music between the hours of 08.00 and 00.00 (provided that no other form of regulated entertainment is taking place at the same time); and
otherwise would not have any effect except if they relate to the prevention of crime and disorder or public safety;
unless of course in either case they had been imposed or brought in to effect following a review.
Nevertheless the applicant has given consideration to the effect of music entertainment on their neighbours and have volunteered conditions under the Public Nuisance category that they are happy to comply with.
We have enclosed a copy letter from the Fire Authority that deals with capacity. This states that the occupancy figures, and subject to final inspection will be:
Ground Floor - 80 persons
First Floor Restaurant - 32 persons
Total including staff - 120 persons

Public Safety
We already understand our obligations under existing Fire and Health & Safety legislation.
It is our opinion that the nature of the operation will not lead to any increase in the risk of public safety.
The prevention of public nuisance
Reasonable steps will be taken to recognise the rights of local residents and to encourage customers to leave the premises quietly.
When amplified musical entertainment is taking place inside the premises after 22.00 hours windows and doors, except for entrance and exit purposes will be kept shut.
