  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  (1)              No supply of alcohol may be made under the premises licence -

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition where the licence authorises the exhibition of films

  ()             Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

  ()             Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

  ()             Where -

  (1)   the film classification body is not specified in the licence, or

  (2)   the relevant licensing authority has notified the premises which holds the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

  ()             In this section -

                              “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39)(authority to determine suitability of video works for classification).

   

  Mandatory condition where Door Supervisors are provided

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

  We intend to make this property available for events to cater for both small and large numbers which will dictate whether the event is held indoors or outside in a marquee.  Any live concert will take place outdoors.  There will be a limited number of large events run and monitored by us to ensure that we are operating within our licensing remit.  We will welcome the input and advice from all appropriate authorities and act upon their recommendations.  We will ensure that we have adequate Public Liability Insurance for the type of events taking place and will work with all statutory bodies (Police, Fire Services etc) to ensure that we are fully compliant with current legislatory and statutory requirements.

   

  The prevention of crime and disorder

  It will be the responsibility of the client & hirer of the venues to ensure their guests act in an appropriate manner but we and our staff will be vigilant at all times to ensure that every event runs smoothly but if there is the likelihood that problems may occur then appropriate action will be taken including contacting the police.

  At larger events, such as concerts, there will be a team of supervisors with clearly defined roles to oversee any transgressions.

   

  Public Safety

  It will be our responsibility as owners of the property to ensure that a risk assessment is in place to comply with Health & Safety Regulations.  All potential hazards both inside the house and in the grounds will be clearly identified and adequate signage and lighting will be provided.

  As above, there will be a team of supervisors with clearly defined roles at large events to ensure public safety.

  A suitable fire risk assessment will be completed to the satisfaction of the Fire Service.

   

  The prevention of public nuisance

  It will be our responsibility to ensure that the occupiers of neighbouring properties are not adversely affected by any event taking place with particular refernce to traffic noise & nuisance as well as noise pollution.  If we receive any complaints these will objectively assessed and acted upon as and where necessary.

   

  The protection of children from harm

  On the occasions when children are invited to the event taking place we expect the parents of the individual children to take full responsibility for them.  In addition, any staff employed by us as waitresses etc will be expected to keep a general eye on any behaviour that could lead to problems.

  As above, at larger events this will form part of the remit of a team of supervisors.
