Annex 2 - Conditions Consistent with the Operating Schedule
Prevention of Crime and Disorder
CCTV
6. A tamper-proof digital CCTV system will be installed and maintained. It will record during all
hours the premises are open to the public and will cover every public entrance and exit, the bar,
the main room, the corridor and lobbies, with at least one weatherproof high-resolution camera
covering the West Walls frontage and at least one high-resolution colour camera at the main
public entrance giving a head-and-shoulders image of every person entering.
7. Recordings will be kept unedited for at least 31 days and made available to a police officer or
authorised officer of the council on request, subject to data protection law. A member of staff able
to operate the system and download footage will be on duty whenever the premises are open.
8. If the CCTV system fails, the licensing authority will be told without delay and the fault
repaired as soon as practicable.
RECORDS
9. An incident log (paper or electronic) will record the time, date and location of any incident of
crime or disorder, its nature, the people involved where known, the outcome and action taken to
prevent a recurrence. Entries will be signed or digitally noted by the DPS or duty manager, kept
for 12 months and made available to the police on request. All crimes on the premises will be
reported to the police.
10. A refusals register (paper or electronic) will be kept and made available to the responsible
authorities on request.
DOOR SUPERVISION
11. SIA-licensed door supervisors will be engaged on a risk-assessed basis for peak trading, latenight
trading and special events, as recorded in the event risk assessment (condition 4). When door
supervisors are on duty a register will be kept of their names, SIA licence numbers and the times
they start and finish, and it will be available to the police, the SIA and authorised officers on
request.
DRUGS, WEAPONS AND WELFARE
12. A zero-tolerance drugs policy will operate. Notices will be displayed. Toilets will be checked
regularly during events and the checks recorded. Any drugs found or seized will be logged, stored
securely and handed to Cumbria Police.
13. The premises will operate the ‘Ask for Angela’ scheme (or its successor). Staff will be trained
to recognise vulnerability and suspected drink-spiking and in what to do, including making sure a
vulnerable person is not left alone and can get home safely.
14. The licence holder will take part in the local Pubwatch scheme where one operates.
ALCOHOL AND DRINKS CONTAINERS
15. No sales of alcohol for consumption off the premises after 22:00. Off-sales will be in sealed
containers only.
16. No open drinks containers will be taken out of the premises onto West Walls. This does not
prevent customers carrying drinks between these premises and the adjoining taproom (PL691)
through the internal link while both are open.
17. Empty glasses and bottles will be collected regularly throughout trading.
SECURITY AWARENESS
18. Managers will complete ACT (Action Counters Terrorism) awareness training, and the
premises will have a written emergency procedure covering evacuation, invacuation and
lockdown.
Public Safety
19. A fire risk assessment will be completed to the satisfaction of Cumbria Fire and Rescue
Service before the premises first open to the public, and reviewed annually and after any material
alteration. It will set the maximum occupancy for each room layout (seated, mixed, standing).
20. The occupancy figure will not be exceeded. At ticketed events and whenever door supervisors
are on duty, numbers will be counted in and out so that the person in charge always knows how
many people are on the premises and can tell an authorised officer, fire officer or police officer on
request.
21. The fire alarm, emergency lighting and fire-fighting equipment will be maintained in good
working order and tested in line with the relevant British Standards, with records kept. All exits
and exit routes will be unlocked, unobstructed and available whenever the public are present. They
will be checked before opening each day and the check recorded.
22. Loose furniture will be set out so that gangways, exits and routes to exits are kept clear at all
times.
23. The modular stage will be put up and taken down by trained staff following the manufacturer’s
instructions and checked before each use. Stage edges and steps will be clearly marked. Stage
power will be RCD-protected and performers’ electrical equipment visually checked before use.
24. Haze or smoke effects, strobe lighting and lasers will only be used after a risk assessment, with
a warning notice at the entrance when strobes or haze are in use. No pyrotechnics or naked-flame
effects will be used unless the licensing authority and Cumbria Fire and Rescue Service have been
given at least 10 working days’ written notice.
25. The brewhouse platform will be guarded and closed to the public at all times, except for
supervised brewery tours. No brewing or cleaning-in-place will take place during a ticketed event
or while the platform is in use as a DJ or performance position. Brewing and cleaning chemicals
will be locked away from public areas. The bar, tank frame and loft are staff-only areas.
26. Suitable first-aid equipment will be kept on the premises and first-aid trained staff will be on
duty during events.
27. Arrangements for the safe evacuation of disabled customers will be set out in writing and all
staff made aware of them.
28. Spillages and broken glass will be cleared promptly. Free drinking water will be readily
available at the bar.
The Prevention of Public Nuisance
NOISE FROM THE PREMISES
29. A noise limiting device will be fitted to the house sound system and set at a level agreed with
the council’s Environmental Health officers before the premises first provide regulated
entertainment. It will be sealed or otherwise secured against tampering and only reset with
Environmental Health’s agreement. All amplified music, including visiting bands and DJs, will be
played through the limited system.
30. Doors and windows will be kept closed whenever regulated entertainment is taking place,
except for access and egress and in an emergency. The main entrance is lobbied. The fit-out
includes acoustic treatment and new windows to the West Walls elevation.
31. While regulated entertainment takes place after 23:00 the duty manager will carry out regular
noise checks outside the premises, including towards the nearest residential property, and turn the
level down if music is likely to disturb residents. Checks and any action taken will be recorded.
32. A telephone number for the duty manager will be made available to neighbouring residents
and businesses. Complaints will be logged and answered.
CUSTOMERS LEAVING
33. A written dispersal policy will operate. The sale of alcohol will stop at least 30 minutes before
the premises close, to allow a gradual wind-down. Notices at every exit will ask customers to
respect neighbours and leave quietly. Staff will supervise the exit and frontage at closing time and
ask customers not to gather outside.
34. Customers will be encouraged to pre-book taxis and to wait inside. Local taxi numbers will be
displayed.
35. Any queue will be supervised and kept orderly along the frontage so that it does not block the
footway.
SMOKERS
36. Smokers will be directed to a designated area on the West Walls frontage by the main
entrance. The area will be monitored by staff or door supervisors, no drinks will be taken outside,
and a bin will be provided and emptied.
WASTE AND DELIVERIES
37. No glass will be tipped into external bins, and no refuse collections or deliveries will be
arranged, between 22:00 and 08:00. The frontage will be checked for litter and swept if needed at
the end of each trading day.
The Protection of Children from Harm
38. Challenge 25 will operate. Anyone who appears to be under 25 must show proof that they are
over 18 before being served alcohol. Accepted proof: passport, photocard driving licence,
EU/EEA national ID card, HM Forces warrant card, a card bearing the PASS hologram, or any
electronic or biometric age-verification technology approved by the licensing authority. Challenge
25 signs will be displayed at the entrance and at the bar.
39. All staff who sell alcohol will be trained in age-restricted sales, preventing under-age and
proxy sales, and using the till prompts, as set out in condition 3.
40. Under-18s are only admitted if accompanied by a responsible adult and must leave by 21:00,
with two exceptions: (a) pre-booked private functions such as weddings and family celebrations;
and (b) ticketed events advertised in advance as open to under-18s. At those functions and events
accompanied under-18s may stay until the function or event ends, and in any case no later than
01:00.
41. No under-18s will be admitted to any event advertised as over-18s only. Events with adult
content will be advertised and run as over-18s only.
42. Notices will state that it is an offence for under-18s to buy alcohol and for anyone to buy
alcohol for them. Under-18s will not be allowed to sit or stand at the bar.
43. Films will only be shown in line with their BBFC classification (or a classification given by
the licensing authority), and admission to a film will be restricted accordingly.
44. No adult entertainment of any kind will take place.
