  Licensing Act 2003 Mandatory Conditions

   

  Alternative licence condition where licence authorises the supply of alcohol

   

  Every supply of alcohol under the premises licence must be made or authorised by the Management Committee.

   

   

  Mandatory condition where Door Supervisors are provided

   

  Where a premises licence includes a condition that one or more individuals must be at the premises to carry out a security activity, they must be licensed by the Security Industry Authority.

   

   

  Mandatory Condition where the licence authorises the exhibition of films

   

  ()             Where a club premises certificate authorises the exhibition of films, the certificate must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

  ()             Where the film classification body is specified in the certificate, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

  ()             Where -

  (1)   the film classification body is not specified in the licence, or

  (2)   the relevant licensing authority has notified the premises which holds the certificate that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

  ()             In this section -

                              “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39)(authority to determine suitability of video works for classification).

   

   

   

• ANNEX 2    Conditions Consistent with Operating Schedule

   

  General

   

  The Village Hall is run by a Committee who will only allow responsible persons the hire of the Hall.

  The Committee are all fully aware of their responsibility under the Licensing Act 2003 and will ensure the legal, safe and smooth running of all events.

   

  Prevention of Crime and Dissorder

   

  Every incident of crime or dissorder will be reported to the Police

   

  Public Safety

   

  Accomodation limits will be:

  Category A : Main Hall 226persons.  

  Category B: Main Hall 190 persons.    

  Small Hall partition closed: 40 persons, open: 60 persons.    

  Category C: Main Hall 360 persons. 

  Small Hall partition closed: 80 persons, open: 100 persons.

   

  A suitable fire risk assessment will be available and will be to the satisfaction of Cumbria Fire Service.

  All fire fighting equipment will be maintained and checked .

  Fire exits will be kept clear at all times.

   

  Prevention of Public Nuisance

   

  Whilst live music is taking place all doors and windows on the premises will remain closed.

  No noise nuisance shall be caused to residents living in the vicinity of the premises.

   

  The Protection of children from harm

   

  When alcohol is sold on the premises during certain events any child attending must be accompanied by an adult at all times.
