  Licensing Act 2003 Mandatory Conditions

   

  Mandatory conditions where licence authorises the supply of alcohol

   

  (1)              No supply of alcohol may be made under the premises licence -

   

  (a)              at a time when there is no designated premises supervisor in respect of the premises licence, or

  (b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)              The supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Mandatory Condition where the licence authorises the exhibition of films

   

  ()             Where a club premises certificate authorises the exhibition of films, the certificate must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this condition.

  ()             Where the film classification body is specified in the certificate, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendations made by that body.

  ()             Where -

  (1)   the film classification body is not specified in the licence, or

  (2)   the relevant licensing authority has notified the premises which holds the certificate that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

  ()             In this section -

                              “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39)(authority to determine suitability of video works for classification).

   

  Mandatory condition where Door Supervisors are provided

   

  Any individual employed on the premises to carry out a security activity must be licensed by the Security Industry Authority.

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

   

  I have undertaken my own risk asssessment to take the following proposed steps.

   

  The types of regulated entertainment proposed materially do no more than reinstate the normal pub entertainment that was previously unregulated as identified in Part B1 of the application.

   

  No new steps have been identified in relation to the four licensing objectives save as below:

        The premises will continue to comply with the Laurel Pub Company Social Responsibility Policy.

   

  The prevention of crime and disorder

   

  No further risks have been identified which need to be addressed, save as below

        Under the present licensing regime the premises already are able to be open until 02.30.

        Door supervisors shall be provided at the premises door to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for licensable activity.  In accordance with the request from Cumbria Constabulary, door supervisors will be on duty at all times when the premises are open for the sale of alcohol after midnight until closing.

        Any door supervisor employed on the premises will be registered with the Security Industry Authority (S.I.A).

        Any person as defined in condition 1. above will clearly display his S.I.A badge at all times whilst on duty.

        No person in possession of a drink in a sealed or unsealed container shall be allowed to enter the premises except for the purposes of delivery whilst the premises are open to the public.

        CCTV will be installed on the premises and the images recorded by the system shall be retained in unedited form for a period of not less than 31 days.  They will be made available to the Police upon request within a reasonable time.

        No drink shall be removed from the premises in an unsealed container, save for consumption in any external area provided for that purpose.

        The maximum occupancy of the building (including staff and performers) will be restricted to 200 persons.

   

  Public safety

   

  No further risks have been identified which need to be addressed, save as below:

   

        To comply with the reasonable requirements of Cumbria Fire Service from time to time.

        To comply with the reasonable requirements of the building control officer.

   

   

  The prevention of public nuisance

   

  No further risks have been identified which need to be addressed, save as below:

   

        There shall be placed a dispersal policy to assist dispersal of clientele from the area in a swift, efficient and safe manner. Notices will be displayed at all exits from the premises in a place where they can be seen and easily read by the public, requiring customers to leave the premises and the area quietly. 

        The noise level from the premises shall not cause nuisance to noise sensitive dwellings in the vicinity.

        Where necessary to liaise with the environmental health department to restrict noise pollution in residential areas.

   

  The protection of children from harm

   

        The restrictions set out in the Licensing Act 2003 will apply.  No unusual or additional risks of harm to children have been identified.

        Persons under the age of 18 shall not be permitted to enter the premises after 22.00hrs.

   

  Public Entertainment

   

  The Standard Conditions for Places of Public Entertainment adopted by this Council in 2002 are applicable to this licence and are attached.

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  Not applicable
